Welcome to Sweetly Toxic. These Terms of Service apply when you visit, browse or purchase from the Sweetly Toxic website.
Throughout these Terms, “Sweetly Toxic”, “we”, “us” and “our” refer to Sweetly Toxic. “You” and “your” refer to customers and users of our website.
By accessing our website or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Returns & Refund Policy, Shipping Policy and any other policies displayed on our website.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or other rights that cannot lawfully be excluded.

1. Using Our Website
You may use the Sweetly Toxic website for lawful personal shopping and browsing purposes.
You must not:
Use the website for unlawful or fraudulent purposes.
Attempt to interfere with the operation or security of the website.
Introduce viruses, malicious code or other harmful material.
Attempt to gain unauthorised access to our systems or customer information.
Scrape, copy or reproduce website content for commercial purposes without permission.
Use Sweetly Toxic intellectual property without authorisation.
Provide false or misleading information when placing an order or communicating with us.
We reserve the right to restrict access to the website where reasonably necessary to protect Sweetly Toxic, our customers or our systems.

2. Products
We aim to describe and display our products as accurately as reasonably possible.
However, colours may appear slightly different depending on your device, screen settings, lighting and photography.
Measurements may also vary slightly due to manufacturing processes and the method used to measure an item.
Customers should carefully review product descriptions, measurements, sizing information, colours and available variants before ordering.

3. Product Sizing
Sizing can vary considerably between brands, manufacturers and styles.
A labelled size such as S, M, L or a numerical size should not be assumed to correspond exactly with your usual Australian clothing size.
Where measurements or size charts are provided, customers should use these when selecting a size.
Ordering an incorrect size is generally considered a change of mind and is handled according to our Returns & Refund Policy.
This does not affect your rights where a product has been incorrectly described or otherwise fails to meet a consumer guarantee.

4. Orders
Placing an order through our website is an offer to purchase the selected products.
An order is not necessarily accepted simply because payment has been submitted or an automated confirmation has been issued.
We may refuse or cancel an order where reasonably necessary, including where:
A product is unavailable.
A supplier is unable to fulfil an item.
An incorrect price or product information has been published.
Payment cannot be successfully processed or verified.
We reasonably suspect fraud or unauthorised activity.
An obvious website or technical error has occurred.
Delivery to the supplied address is not reasonably possible.
If we cancel an order after payment has been received, we will provide an appropriate refund for the cancelled item or order.

5. Product Availability
Sweetly Toxic operates using a combination of stocked and sourced-to-order products.
Some products are sourced specifically after you place your order.
Although we make reasonable efforts to keep availability information current, supplier stock can change quickly.
If an ordered product becomes unavailable, we may contact you to offer an alternative where appropriate or provide a refund for the unavailable item.

6. Processing Times
Unless otherwise stated on the relevant product page, please allow approximately 7–10 business days for order processing before dispatch.
Processing time is separate from shipping/delivery time.
During sales, launches, public holidays, peak shopping periods or other unusually busy periods, processing may take longer.
Where a materially different processing period applies to a particular product, we will aim to disclose this on the product page.

7. Split Shipments
Depending on the products purchased, availability and fulfilment arrangements, products within the same order may be dispatched separately and may arrive in more than one parcel.
Receiving one parcel does not necessarily mean the remainder of your order has been forgotten or is missing.
Where tracking is available, customers may receive separate tracking information for different parcels.

8. Prices & Currency
Unless otherwise stated, prices displayed on the Sweetly Toxic website are in Australian Dollars (AUD).
Prices may change from time to time without notice.
A price change will not normally affect an order that has already been accepted, except where there has been an obvious pricing or technical error.
International customers should be aware that their bank or payment provider may apply currency-conversion fees or other charges.

9. Payments
We accept the payment methods displayed at checkout.
These may include credit/debit cards, Shopify-supported payment methods and approved Buy Now, Pay Later providers.
Payment services may be operated by third parties and may be subject to additional terms imposed by those providers.
Sweetly Toxic does not directly store customers' complete payment-card details.

10. Buy Now, Pay Later
Where you choose a Buy Now, Pay Later service, your use of that payment method is also subject to the provider's terms and eligibility requirements.
Refunds relating to Buy Now, Pay Later purchases will generally be processed through the relevant provider.
Sweetly Toxic is not responsible for decisions made by a third-party payment provider regarding eligibility, account limits or approval.

11. Shipping & Delivery
Shipping destinations, charges, estimated delivery times and other delivery information are explained in our Shipping Policy and at checkout where applicable.
Delivery estimates are estimates rather than guaranteed arrival dates unless expressly stated otherwise.
Delays can occur due to postal networks, couriers, customs, weather, peak periods and other circumstances outside our reasonable control.
Your rights under Australian Consumer Law remain unaffected.

12. International Orders, Customs & Import Charges
Sweetly Toxic currently offers international shipping to selected countries.
International orders may be subject to customs inspections, import duties, taxes, fees or other charges imposed by the destination country.
Unless otherwise required by law or expressly stated by Sweetly Toxic, these charges are the responsibility of the customer and are not included in the product or shipping price charged by Sweetly Toxic.
Customers are responsible for checking any applicable import requirements in their country.

13. Delivery Addresses
Customers are responsible for providing a complete and accurate delivery address.
Please check your details carefully before submitting an order.
If you notice an error, contact us as quickly as possible. We cannot guarantee that an address can be changed once processing or dispatch has commenced.
Additional charges may apply where an order needs to be resent because an incorrect or incomplete address was supplied by the customer.

14. Tracking
Where tracking is available, tracking details will be provided after dispatch.
Tracking information can sometimes take time to update after a parcel enters the carrier's network.
Please refer to our Shipping Policy for further information regarding tracking, delayed parcels and delivery.

15. Returns, Refunds & Cancellations
Returns, refunds, exchanges and cancellations are handled according to our Returns & Refund Policy.
Many products are sourced specifically after an order is placed, so change-of-mind cancellations may not be possible once sourcing or processing has commenced.
Nothing in these Terms limits your rights under Australian Consumer Law.

16. Promotions & Discount Codes
From time to time, Sweetly Toxic may offer sales, promotional offers or discount codes.
Unless otherwise stated:
Discount codes cannot be exchanged for cash.
Discount codes cannot normally be combined.
Only one promotional code may be used per order.
Discounts must be applied before checkout is completed.
Discounts cannot generally be retrospectively applied to completed orders.
Promotional offers may have eligibility requirements or expiry dates.
Promotions may exclude particular products or collections.
We may cancel or refuse the use of a promotion where we reasonably believe it has been used fraudulently, contrary to its stated terms or because of an obvious technical error.

17. Gift Cards
Where Sweetly Toxic offers gift cards, additional conditions displayed when purchasing or redeeming the gift card may apply.
Gift cards are not redeemable for cash except where required by law.

18. Reviews & Customer Content
Customers may have opportunities to submit reviews, photographs, comments or other content.
By voluntarily submitting content for publication, you confirm that you have the right to provide that content and that it does not infringe another person's rights.
We may moderate or remove content that is unlawful, abusive, misleading, spam, unrelated to the product or otherwise inappropriate.
Submission of a review does not guarantee publication.

19. Sweetly Toxic Intellectual Property
The Sweetly Toxic brand and its original creative material are important business assets.
Unless otherwise stated, original material created for Sweetly Toxic — including our:
Business and brand name.
Sweetly Toxic logos and branding.
Website graphics and written content.
Original artwork and illustrations.
Original product and merchandise designs.
Marketing artwork and graphics.
Packaging designs.
Original character artwork, character designs, names, personalities and associated creative material.
may be protected by copyright, trade mark rights and/or other intellectual-property rights.
Such material must not be copied, reproduced, modified, distributed, sold, commercially exploited or represented as another person's work without appropriate permission.

20. Blossom Fox & Sweetly Toxic Original Characters
Blossom Fox is an original Sweetly Toxic character and part of the Sweetly Toxic brand identity.
Blossom Fox, together with other original characters developed or commissioned by Sweetly Toxic, and their associated artwork, designs, names, distinctive visual elements, stories and branded merchandise, form part of Sweetly Toxic's original creative property to the extent Sweetly Toxic owns or holds rights in that material.
Unless permission has been expressly granted, you must not:
Copy or reproduce our original character artwork for commercial purposes.
Sell merchandise featuring our original characters or artwork.
Trace, redraw or substantially reproduce our artwork for commercial use.
Use our characters to promote another business, product or service.
Create or sell counterfeit or unauthorised Sweetly Toxic character merchandise.
Remove Sweetly Toxic branding from our original artwork and present it as your own.
Use Sweetly Toxic character names, branding or artwork in a way that falsely suggests an official partnership, endorsement or affiliation.
Personal, non-commercial fan art may be welcomed, provided it is not sold or represented as official Sweetly Toxic merchandise.
Nothing in this section claims ownership over third-party products, artwork, characters or intellectual property that Sweetly Toxic does not own.

21. Third-Party Products & Intellectual Property
Sweetly Toxic sells both sourced products and original Sweetly Toxic products.
Third-party brands, artwork, product designs, characters, trademarks and other intellectual property remain the property of their respective owners.
Our intellectual-property provisions apply only to material Sweetly Toxic owns or has appropriate rights to use.

22. Unauthorised Commercial Use
Sweetly Toxic reserves the right to take reasonable action where our original intellectual property is copied or commercially exploited without permission.
This may include requesting removal of infringing material, reporting unauthorised listings to marketplaces or platforms, or seeking professional advice where appropriate.

23. Website Content
Information on our website is provided for general shopping and informational purposes.
We aim to keep information accurate and current but cannot guarantee that every website error will be identified immediately.
We may correct typographical errors, inaccurate information or omissions and update website content where reasonably necessary.

Sweetly Toxic does not control those third-party services and is not responsible for their content, availability, privacy practices or separate terms.

26. Consumer Guarantees
Our products come with guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances, customers may be entitled to remedies where goods fail to meet applicable consumer guarantees.
Nothing in these Terms is intended to exclude, restrict or modify those rights.

27. Limitation of Liability
To the maximum extent permitted by law, Sweetly Toxic will not be liable for indirect or consequential loss arising from use of our website or products where such liability may lawfully be excluded.
Nothing in this section excludes liability or remedies that cannot legally be excluded, including applicable rights under Australian Consumer Law.

28. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes to our website, products, business practices or legal requirements.
The current version will be published on the Sweetly Toxic website with an updated revision date.
Your purchase will generally be governed by the terms applicable when your order was placed, subject to applicable law.

29. Governing Law
These Terms are governed by the laws of Victoria, Australia, and applicable Commonwealth laws of Australia.
